Terms and Conditions
Basis of use of the Skycat.pro website
The Skycat.pro website is provided to you free of charge for your personal use subject to these Terms and Conditions and our Privacy and Cookies Policy. By using the Skycat.pro website you agree to be bound by these Terms and Conditions and our Privacy and Cookies Policy. These Terms and Conditions govern your use of the Skycat.pro website in general, the products that you purchase on the Skycat.pro website and all services provided in connection with them. These Terms and Conditions do not affect your statutory rights.
Registration
To use the Skycat.pro website you must be over eighteen years of age. You must ensure and you will be responsible that the details provided by you on your order or at any other time are correct and complete.
Descriptions and prices of products
We have taken care to describe and show products as accurately as possible. Despite this, products may vary from their descriptions. All specifications are subject to change without notice. Latest specifications are available from product page. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of a product does not include the delivery charge, which will depend on the delivery method you choose and will be added during checkout. We make every effort to ensure the prices on our website are correct but we can sometimes make a mistake. If we notice a material price mistake before we dispatch something you have ordered, we will ask if you want to pay the correct price or cancel your order. If we do not hear from you, we will cancel your order.
We reserve the right to change prices listed without notice. All orders for product(s) are subject to availability. We reserve the right to refuse to supply to any individual or company.
The agreement (contract) between you and us
All orders are made subject to these Terms and Conditions.
Your order is an offer to buy from us. We will send you an order confirmation email detailing the products you have ordered. The contract between us is only created once we send you the products you ordered, and not before. It means we have accepted your offer and fully communicated this to you. At any point up until the contract is made, we may decline to supply a product to you. Once we're about to send out your order, we debit your payment card with the total cost of the items we're sending you.
In unexpected events when we decline to supply a product to you and you have already paid for it, we will give you a full refund of any amount already paid for that product in accordance with our return and refund policy.
You may cancel any order prior to the point at which we email you to confirm dispatch of your order (in certain circumstances your right to cancel continues until 14 Calendar days after the day of delivery).
Though we check our system frequently to try and avoid errors, things can occasionally go wrong with the ordering process. If we make a mistake we will do our best to put things right as quickly as we can, with as little inconvenience to you as possible. We do however reserve the right to cancel any order for any reason at any time prior to dispatch, for example (but not limited to) where there is an obvious material mistake in the price or product information.
Availability of products
We update our availability information regularly but occasionally the (a) Product may run out between updates.
We do our best to dispatch your Product(s) within the lead time shown on the Product page when you order. If this is not possible, your order will be sent out as soon as the Product(s) become available. If we can't supply your order within 30 days, we will cancel the order - except for Product(s) that have not been published or released yet.
The dispatch and delivery times shown are approximate and delays can sometimes occur. Delivery times are based on working days (Monday-Friday, excluding Public Holidays).
We will email you as soon as your order is ready to be dispatched.
Delivery restrictions
We use only express delivery with tracking with weight based pricing. Certain products are subject to delivery restrictions. You will find details of any delivery restriction displayed on the Product page. We do not ship products to the following countries: China, Cuba, Iran, Iraq, Syria, North Korea, Myanmar (formerly Burma), Yugoslavia and Sudan. We apologize for the inconvenience. PO Box addresses: in some instances we may not be able to deliver parcels to PO Box address - we will let you know if there is an issue.
Safety
Your safety is your own responsibility, including proper use of equipment and safety gear, and determining whether you have adequate skill and experience. The Products maybe dangerous, unless used properly and with adequate precautions, including safety gear. The Products are not intended for use by children.
Use of the instructions, kits, projects and suggestions here is at your own risk. Skycat.pro disclaims all responsibility for any resulting damage, injury, or expense. It is your responsibility to make sure that your activities with the Products comply with applicable laws in your country.
Payment details
All Product prices and delivery charges are shown in Euro. We accept payment by Stripe - Discover, Visa, Mastercard, and American Express.
Before we confirm your order we carry out a standard pre-authorisation check on your card to make sure there is enough money available to pay for it.
We ask your bank to set aside (or reserve) the money in your account to pay for your order. Although this money may still show in your account, you won't be able to spend it. We typically reserve funds for 7-10 days and take the money when we send your order to our distribution centre for picking.
Your card will only be charged when the items in your order are ready to be dispatched.
We offer free shipping for orders over 500 EUR.
For international orders, you are also responsible for any tariffs, taxes, fees, VAT, duties due upon receipt. You are responsible for filing any claims with carriers for damaged and/or lost shipments.
Our responsibility to you
The Skycat.pro website is provided by Skycat without any warranties or guarantees. You will bear the risks associated with the use of the internet. If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you order the relevant product or the time you otherwise use the Skycat.pro website. Our responsibility to you shall not include any business losses such as lost data, lost profits, lost sales or business interruption.
We are not responsible for delays, loss or damage stemming from shipments sent to incorrect, invalid addresses or correct addresses. Orders may end up being returned for various reasons including: non-payment of tariffs, incorrect address, unclaimed at post office, etc. If a package is returned or rejected, the customer will be contacted and will have to pay for re-shipment postage. We are not responsible for damaged or lost packages shipped via ……. at any time or under any circumstance. Not all packages are insured.
Limitation of liability
If either of us fails to comply with these Terms and Conditions, neither of us shall be responsible for any losses that the other suffers as a result, except for those losses which are a foreseeable consequence of the failure to comply with these Terms.
Subject to the above, our total liability to you for all and any damages, losses, and causes of action shall not exceed the total of the amount paid by you, if any, for accessing the website, purchasing the Products and/or using the Services provided via the website and any foreseeable consequential loss or damage you may incur as set out above.
Neither party shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond that party's control.
Third party websites
As a convenience to Skycat customers, the Skycat.pro website may include links to other websites or material. Skycat is not responsible for any of these websites or material, which is beyond its control.
Indemnification
You agree to indemnify, defend, and hold harmless Skycat.pro Inc, its officers, directors, employees, agents, owners, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
Intellectual property
The content of the Skycat.pro website is the property of Design Hiisilä Oy and/or our affiliates or licensors, and is protected by copyright, trademarks, database and other intellectual property rights. All brand names, product names and titles used in this site are the trademarks or trade names of their respective holders. No permission is given in respect of use of any of the above, and such use may constitute an infringement of the holders' rights.
You may retrieve and display the content of the Skycat.pro website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.
You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Skycat.pro website without written permission from Skycat. No licence is granted to you in these Terms and Conditions to use any trademark of Skycat or its affiliated companies. You may not use the Skycat.pro website or the materials available on the website in a manner that constitutes an infringement of our rights or that has not been authorized by us.
When you submit or post any material via the website, you grant us, and anyone authorized by us, a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to use, copy, modify, transmit, create derivative works from, distribute, and/or publicly perform or display such material, in whole or in part, in any manner or medium (whether now known or hereafter developed), for any purpose that we choose. The foregoing grant includes the right to exploit any proprietary rights in such posting or submission, including, but not limited to, rights under copyright, trademark or patent laws that exist in any relevant jurisdiction. Also, in connection with the exercise of these rights, you grant us, and anyone authorized by us, the right to identify you as the author of any of your postings or submissions by screen name, as we deem appropriate. You understand that the technical processing and transmission of the website, including content submitted by you, may involve transmissions over various networks, and may involve changes to the content to conform and adapt it to technical requirements of connecting networks or devices. You will not receive any compensation of any kind for the use of any materials submitted by you. We reserve the right to limitations on linking and framing.
Advertising and sponsorship
Part of the Skycat.pro website may contain advertising and sponsorship. Third party advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Skycat.pro website complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material provided by third parties.
Promotions and discounts
All promotions are subject to availability. Prices and promotions change a lot online. We will always charge you the price we gave you when you placed your order, even if a promotion is subsequently withdrawn.
Availability of the Skycat.pro website
Although Skycat aims to offer you the best service possible, Skycat cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to the customer services or by email at hq@skycat.pro and we will attempt to correct the fault as soon as we reasonably can. Your access to the Skycat.pro website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Skycat.pro or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
Severability
If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.
If any invalid, unenforceable or illegal provision of these terms would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
Disposal of electrical products
Electrical products are often full of nasty chemicals and can have a harmful effect on natural habitat, wildlife and also human health. It is very important that these products are either recycled or otherwise disposed of safely.
All new electrical products now carry a symbol of a crossed-out wheelie bin. This means it should be disposed of carefully, and not thrown out with general household waste.
Governing law
Skycat.pro website may not comply with legal requirements of foreign (other) countries. Other countries may have laws and regulatory requirements that differ from those in Finland. By using this website, you agree to the transfer and processing of any personal information you provide to Finland as set forth herein and under the laws of Finland, rather than under the law of your home country.
These terms and conditions, privacy policy and any contract between us are governed by Finnish Law without regard to choice of law provisions and we both agree to the non-exclusive jurisdiction of the Finnish Courts in Helsinki.
Statutory rights
Nothing in these conditions will reduce your statutory rights relating to faulty or misdescribed Products.
Disclaimer
Skycat.pro and/or their respective suppliers make no representations or warranties about the accuracy, completeness or suitability for any purpose of the information contained in the documents and related graphics published in this site; or any of the products of whatever nature, details of which appear on this site.
All such documents and related graphics are provided, and any such products (where ordered) are accepted by customers, "as is" and without warranty of any kind.
Should a price change outside the guidelines indicated, we will contact you by email and ask if you wish to proceed. You will have no obligation to purchase the product(s) at the new price quoted. Although using the latest encrypted security software from Stripe the security of information and payments transmitted via the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part be borne by Skycat.pro.
Skycat is a backup system designed to help decreasing the kinetic energy at impact of your multicopter, UAV or radio controlled model in the case a loss of control. Skycatcannot prevent your multicopter, UAV or radio controlled model from causing damages at impact. It is only designed to eject a parachute in order to lower the speed of yourmachine in free fall. Skycat is strictly a backup device and does not replace proper training and timely execution of appropriate emergency procedures.
Skycat is an electro-mechanical device and as such, it can fail to work properly whichcan result in false activation or no activation at all. Such an inappropriate act can cause injuries or death. In case of false activation or even intended activation at the wrong time, the ejection of
the parachute can cause your multicopter, UAV or radio controlled model to fly further
and cause more damages than it had if it had fallen in free fall.
Skycat disclaims all warranties, whether expressed or implied, including but not limited to
the implied warranties of merchantability and fitness for a particular purpose. Skycat
does not assume any liability, whether direct or indirect from the use of Skycat products.
In no event shall Skycat be liable for personal injury up to and including death.
Miscellaneous
You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
If you breach these Terms and Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms and Conditions.
You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the website. You agree to use the website, and to purchase services or products through the website, for legitimate, non-commercial purposes only. You also agree not to make any purchases for speculative, false or fraudulent purposes or for the purpose of anticipating demand for a particular product or service.
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the website, or any portion thereof, with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension or discontinuance of the website or any portion thereof.
